Terms of Service

1. Who can use Tacyon

You must be at least 16 years old to create an account, or at least 13 with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. You’re responsible for everything that happens under your account, including activity by anyone you invite to a server you control. Keep your login secure and let us know promptly if you believe it’s been compromised.

2. The Service

Tacyon provisions and runs Minecraft servers on your behalf. Your world is kept saved and ready, and is started so you and the players you invite can connect. We provide the Service on a pay-as-you-play basis as described in our pricing and on the Pay-as-you-play page. We may add, change, or remove features over time, and during the current beta the Service is provided as-is and may change frequently.

3. Billing & credit

The Service is prepaid. You add account credit, and we draw down that credit for a per-server monthly base fee plus usage (RAM used while your server is running, and any disk above the included allowance), at the rates shown in your dashboard. Promotional credit (for example, beta sign-up credit) has no cash value and may expire. If your credit reaches zero, your server stops accepting connections but your world stays saved; top up to start it again. Refunds are governed by our Refund Policy. Taxes, where applicable, are your responsibility.

4. Acceptable use

You agree not to use the Service to:

• break the law, infringe others’ rights, or violate Mojang’s or Microsoft’s Minecraft EULA;
• host or distribute malware, run attacks, send spam, or mine cryptocurrency;
• attack, overload, probe, or attempt to bypass the limits or security of our infrastructure or anyone else’s;
• host content that is illegal, or that harasses, exploits, or endangers others (including any sexual content involving minors);
• resell or sublicense the Service in a way that disguises abusive activity.

You own and are responsible for the content, worlds, plugins, and mods you upload or run. You must have the rights to use them, and you’re responsible for complying with their licenses.

5. Suspension & termination

You can stop using the Service and delete your servers at any time. We may suspend or terminate accounts or servers that violate these Terms, that put our infrastructure or other customers at risk, or where required by law. Where practical we’ll give notice and a chance to fix the problem, but serious abuse may be acted on immediately. On termination, your right to use the Service ends; we’ll make a reasonable effort to let you export your data first unless that isn’t possible or appropriate.

6. Backups & data

We take reasonable measures to keep your world data safe and offer backup features, but no hosting service is immune to data loss. You’re responsible for keeping your own copies of anything you can’t afford to lose. The Service is provided without a guarantee of uninterrupted availability.

7. Disclaimers & limitation of liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied. Tacyon will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.

8. Changes to these Terms

We may update these Terms as the Service evolves. If we make a material change we’ll update the date above and, where appropriate, notify you. Continuing to use the Service after a change means you accept the updated Terms.

9. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction.
